EPA and NPDES Compliance

The new Phase II regulations were finalized in December 1999 and automatically designated operators of "small" construction activities (1 to 5 acres) to apply for a storm water permit. Operators are required to obtain a permit (under the NPDES program) from the appropriate regulating authority and implement practices to minimize storm water runoff. Sediment runoff rates from construction sites can be up to 20 times greater than those from agricultural and up to 2000 times greater than those of forest lands. Erosion and sediment-related processes are the single largest cause of impaired water quality.

At least 10 days prior to the initiation of construction activities, a completed application form, and a certification that a storm water management plan is complete must be submitted to the state. Fines associated with a failure to comply with the regulations could be up to $10,000 per day. Criminal pollution of state waters is punishable by fines up to $25,000 per day. Erosion control and sediment control are usually the BMP's applied to construction sites. Erosion control is the process of preventing soil particles from being dislodged; sediment control is the process of removing soil particles from runoff once they have been dislodged.
